How North Carolina’s Juvenile Laws Work Today

North Carolina’s juvenile justice framework has changed significantly in recent years, and families need accurate, current information. The Juvenile Justice Reinvestment Act, commonly called Raise the Age, took effect December 1, 2019, extending juvenile court jurisdiction to cover most offenses committed by individuals under 18. Cases begin in juvenile court rather than adult criminal court.

What Changed with Session Law 2024-17

But the law kept evolving. Session Law 2024-17, effective December 1, 2024, shifted original jurisdiction for Class A through E felonies alleged against 16- and 17-year-olds directly to criminal court. Those cases no longer begin in juvenile court at all. For Class F and G felonies committed by someone aged 16 or 17, the case remains in juvenile court, but mandatory transfer to Superior Court is generally triggered upon a finding of probable cause or a true bill of indictment unless the prosecutor chooses to retain the matter in juvenile court. Class H and I felonies and most non-motor-vehicle misdemeanors stay in juvenile delinquency court.

The “Once an Adult, Always an Adult” Rule

If a juvenile obtains a criminal conviction in district or superior court, that individual is generally barred from juvenile court jurisdiction for any future offense.
