What is Solicitation?

Solicitation, in the legal sense, is the act of asking or encouraging another person to engage in an unlawful act. In the context of sex crimes, solicitation involves proposing sexual contact with someone in a manner that is illegal, e.g. attempting to have sex with a prostitute or a minor.

Sexual Solicitation Crimes

It is illegal to engage in prostitution, either as a prostitute or as a customer (or “John”). The act of requesting sex from a prostitute (or undercover police officer posing as a prostitute) is known as solicitation.

Solicitation of a minor is a serious crime. Any person who has tried to engage in sexual contact with someone who is under the age of consent can be charged with solicitation in addition to other sex crimes. This charge can be applied whether the alleged offender has ever had in-person contact with a minor, as in the case of sexual solicitation of a minor via the internet.

Penalties for Solicitation in North Carolina

In the state of North Carolina, a first-offense solicitation charge will be categorized as a Class 1 misdemeanor, at minimum. Charges for solicitation can become more serious based on aggravating factors that are present in the case, such as if solicitation of a minor was involved. People who are found guilty of solicitation in North Carolina may face penalties such as jail time, fines, community service, and sex offender registration. As with any sex crime, solicitation charges can have serious consequences on a person’s employment and educational opportunities, custody arrangements, and personal life, in addition to the criminal penalties.
