50B & 50C Protective Order Defense in Winston-Salem
A Coordinated Defense for Your Protective Order & Related Criminal Case
A protective-order proceeding can impose immediate restrictions before any related criminal charge is resolved. Eustache Law defends respondents in Winston-Salem when a 50B protective order or 50C civil no-contact order arises from the same alleged incident as a criminal case.
We investigate the allegations, examine the evidence, and identify weaknesses that may affect the civil hearing or criminal proceedings. We also explain the active order, your court obligations, and the separate accusations you may need to address.
If you’ve been served with a protective order or summons, call (336) 827-9208 to discuss your next steps with our defense team.
50B vs. 50C Protective Orders in North Carolina
Although both are sometimes called restraining orders, proceedings under Chapters 50B and 50C apply to different relationships and alleged conduct. Knowing which action has been filed is essential because the required proof, available restrictions, and enforcement mechanisms differ.
50B Domestic Violence Protective Orders
Chapter 50B requires one of these qualifying personal relationships:
- Current or former spouses
- People who live or previously lived together
- Parents and children
- People with a child in common
- Current or former dating partners
The allegations may involve bodily injury or fear of imminent serious bodily injury, continued harassment causing substantial emotional distress, or certain sexual offenses. A judge may issue a temporary order on an ex parte basis before the respondent has an opportunity to respond.
50C Civil No-Contact Orders
A 50C civil no-contact order doesn’t require a personal relationship between the parties. It addresses alleged unlawful nonconsensual sexual conduct or stalking by a person who’s at least 16 years old.
A temporary ex parte order under Chapter 50C requires specific facts showing immediate injury, loss, or damage before the respondent can be heard. It generally can’t exceed 10 days unless the court extends it.
Responding to an Order in Forsyth County District Court
Protective-order actions in Winston-Salem are filed with and heard in Forsyth County District Court. After a temporary 50B order is issued and served, a full hearing is typically set so both parties can present their positions.
A summons in a 50B or 50C action requires an answer within 10 days after service. The respondent must follow every term of an active order while preparing for the hearing, even when the allegations are disputed.
Early preparation should address:
- The filed allegations: The conduct, dates, and relationships described in the complaint.
- Available evidence: Messages, recordings, photographs, witness accounts, and other materials connected to the allegations.
- Current restrictions: No-contact terms, stay-away provisions, firearm requirements, and other conditions already imposed.
- Related charges: Any criminal accusation or upcoming appearance arising from the same alleged conduct.
Restrictions & Enforcement Under 50B & 50C
A 50B order can direct a respondent to stop specified conduct, leave a shared residence, avoid contact with the protected person or children, and surrender firearms. It may also grant temporary possession of a residence, custody, or support. A final order lasts for a fixed period of up to one year and may be renewed for up to two years at a time upon good cause.
Violating a valid 50B order is a Class A1 misdemeanor carrying up to 150 days in jail. A third or subsequent violation after two prior Chapter 50B convictions can be charged as a Class H felony.
A civil no-contact order under Chapter 50C may prohibit contact, stalking, harassment, or interference. It can also require the respondent to stay away from the protected person’s home, school, or workplace. A permanent order lasts for a fixed period of up to one year and may be extended.
A knowing violation of an order issued under Chapter 50C is handled through civil or criminal contempt, a court process for enforcing compliance. Contempt may result in a fine or imprisonment. By contrast, a 50B violation is prosecuted as a criminal offense.
Coordinated Defense for Civil & Criminal Proceedings
A civil protective-order hearing and a related criminal case are separate proceedings, even when both concern the same alleged incident. Evidence and statements from one proceeding, including court filings and orders, may affect decisions in the other. We account for that overlap rather than treating each proceeding in isolation.
Founding attorney Harold J. Eustache Jr. is a former Assistant District Attorney who handled domestic violence prosecutions. He has tried hundreds of cases in District and Superior Courts. That background informs how we review and challenge evidence, prepare for testimony, and address related criminal accusations.
Our restraining-order defense in Winston-Salem coordinates preparation for the civil hearing with any related criminal appearance while keeping you informed about restrictions that remain active.
