Reckless Driving Defense in Winston-Salem
Former Prosecutorial Insight Shapes Your Defense
A reckless driving allegation requires close attention to the conduct the state claims violated North Carolina law. At Eustache Law, we investigate the arrest, examine the prosecution’s evidence, and develop a defense strategy around the circumstances of the charge. We represent drivers in Winston-Salem, Forsyth County, Guilford County, and the surrounding region.
Prosecutors must prove every legal element beyond a reasonable doubt. We look for evidentiary and legal weaknesses that may prevent them from meeting that standard. We also communicate directly with clients so they can ask questions and understand each stage of the proceedings.

What Qualifies As Reckless Driving in North Carolina?
North Carolina recognizes two statutory theories of reckless driving under N.C. Gen. Stat. § 20-140. Subsection (a) covers driving carelessly and heedlessly in willful or wanton disregard for the rights or safety of others on a highway or public vehicular area. Willful or wanton disregard generally involves conduct showing conscious indifference to those rights or safety interests.
Subsection (b) addresses driving without due caution and circumspection at a speed or in a manner that endangers, or is likely to endanger, a person or property. Due caution and circumspection means the degree of care and attention expected under the circumstances. When one continuous course of driving violates both subsections, it constitutes one reckless driving offense rather than two separate offenses.
Reckless driving is a criminal charge, not a routine speeding infraction. It also differs from aggressive driving, a separate offense that can arise when specified reckless driving conduct is combined with speeding under N.C. Gen. Stat. § 20-141.6. Identifying the charge and statutory theory is essential to determining what the state must prove.
Criminal, License & Insurance Consequences
Reckless driving under subsections (a) and (b) is a Class 2 misdemeanor. Because it’s a criminal charge rather than a simple traffic infraction, a conviction becomes part of the driver’s criminal record.
A misdemeanor conviction can expose a driver to court-imposed penalties. Fines aren’t fixed at one amount and can vary based on the case and the court. A conviction may also carry driver’s license points and insurance points, creating consequences beyond the courtroom.
How We Defend Reckless Driving Allegations
Founding attorney Harold J. Eustache Jr. is a former Assistant District Attorney for Forsyth and Rockingham Counties. His prosecutorial experience informs how we assess the state’s theory, identify the evidence supporting each required element, and prepare to challenge the allegation. He has tried hundreds of cases in District and Superior Courts.
We investigate the alleged offense and review the evidence available to the prosecution before court proceedings begin. That preparation guides our approach to pretrial negotiations and allows us to advise each client based on the facts of the case.
A reduction or dismissal may be possible in some cases, but no particular resolution is automatic. The outcome can depend on the evidence, controlling law, prosecutor’s decisions, and court process. If a case proceeds to trial, we represent clients in bench or jury trials and require the state to carry its burden of proof.
Reckless Driving Cases in Forsyth County District Court
Reckless driving and other misdemeanor traffic matters in this area are handled through District Court at the Forsyth County Courthouse in Winston-Salem. The court is part of North Carolina’s 31st Judicial District and has jurisdiction over minor criminal offenses and traffic infractions. A case may move through these stages:
- Arraignment: The court formally advises the accused person of the charge and receives a plea.
- Pretrial: The parties gather evidence, exchange discovery, and may conduct plea negotiations. Discovery is the process through which case information and evidence are disclosed before trial.
- Trial: If the case isn’t resolved during the pretrial stage, it can proceed to a bench or jury trial as allowed by the applicable process.
- Sentencing: Following a conviction, the court determines the penalties under the governing law and circumstances of the case.
We guide clients through each stage and remain available to answer questions along the way.
