Auto Theft Can Involve Different North Carolina Charges
Auto theft is a general phrase, not a single charge under North Carolina law. The State may pursue a larceny charge based on an alleged taking. It may instead allege that someone received, possessed, or transferred a stolen vehicle. The defense depends on the statute charged and the conduct described in the accusation.
Under N.C. Gen. Stat. § 14-71.2, knowingly receiving or transferring possession of a stolen or unlawfully taken vehicle, or possessing one with the required knowledge, is a Class H felony. That offense is distinct from an allegation that a person stole the vehicle, which falls under North Carolina’s larceny statute. Because larceny classification can depend on the property’s value and other statutory circumstances, the phrase auto theft doesn’t automatically identify the charge level or establish a particular felony offense.
Whatever charge is filed, the State must prove every required element beyond a reasonable doubt. We compare those elements with the available evidence and focus the defense on what the prosecution can and can’t establish.
Evidence That May Shape a Stolen Vehicle Defense
Recovering a vehicle doesn’t resolve every issue in the case. The evidence may leave disputes about identity, permission, possession, control, criminal intent, or knowledge that the vehicle was stolen.
